The Machine of the Year 2020 Audience Choice Award is being organised by Deutscher Landwirtschaftsverlag GmbH for this year’s Agritechnica. It costs nothing to vote. Voting is subject to the conditions of participation listed below.
The voting process is independent of the competition and subject to a different set of conditions. The terms and conditions for the competition can be found here.
Purpose of the vote
Votes will be cast for the competition category ‘Machine of the Year 2020 – Audience Choice Award’. Every two years at Agritechnica, technical editors put together a shortlist of innovations of agricultural machines. These are classified in different categories. The winners of each category are then selected by a panel of judges. There is, however, one category that is decided by the public – the Machine of the Year 2020 Audience Choice Award. Users of the machines select their personal favourite by casting their vote online. The web page where users can cast their vote is www.machineoftheyear.de. Voting opens at 16:00 CEST on 21/10/2019 and closes at 23:59 CET on 10/11/2019. Users can vote for each machine, once a day, via the online system. The machine that has received the most votes after the close of voting wins the award in this category. The result will be announced at Agritechnica on 12/11/2019 and on the homepage (www.machineoftheyear.de) on 13/11/2019.
Conduct of the vote
The voting period will run from 21/10/2019 (from 16:00 CEST) to 10/11/2019 (23:59 CET). During this period, users will have the opportunity to vote online.
Participation is open to individuals residing in Germany, Austria, Switzerland, the Netherlands, Belgium, Lichtenstein, France, Italy, Denmark, Poland, Russia, Sweden, Ukraine, Hungary and Bulgaria. The country of residence is determined by the IP address. The details entered by the participant must be true. Failure to comply may lead to the exclusion of the participant (person casting the vote). The participant bears sole responsibility for the correctness of the details entered. Upon request, the participant must prove the accuracy of this information beyond doubt.
Participation in the voting process is free of charge.
Exclusion from participation
The organiser reserves the right to exclude other persons from participation over and above the category defined in Clause 3 if due cause can be shown. Due cause would particularly apply if it turns out that a participant contravenes the prohibition on multiple participation (see Clause 4) or otherwise breaches the terms of participation. Persons who obstruct or interfere with the orderly conduct of voting (e.g. by manipulating or attempting to manipulate the voting procedure and/or breach the rules of participation and/or unfairly attempt to influence the voting, in particular by hacking into the software or by threatening/harassing the organiser or other participants) will also be excluded from participation. We expressly reserve the right to apply further sanctions and take further measures, e.g. pursuing a civil suit or laying criminal charges.
Termination of voting
The organiser expressly reserves the right to terminate the voting without prior notice and without giving reasons. This applies in particular to any reasons that would disrupt or prevent the orderly conduct of the vote.
The organiser undertakes not to disclose any data submitted by participants to third parties. The organiser collects, stores and processes the e-mail address of the persons participating in the voting exclusively for the purpose of conducting the vote for Machine of the Year 2020 Audience Choice Award. When online voting has finished, the e-mail addresses will be deleted. Participants have the legal right to know what personal data the organiser holds on them. Queries or complaints in connection with this public vote should be directed to Deutscher Landwirtschaftsverlag GmbH. This public vote is subject exclusively to the law of the Federal Republic of Germany. Recourse to the courts is excluded.
If any provision of these conditions of participation is shown to be unenforceable either in part or in its entirety, the general validity of the conditions of participation will not be affected. In place of the unenforceable provision, a legally permissible provision which comes closest to the meaning and purpose expressed in the unenforceable provision shall become applicable. The same applies in the event of a loophole in these conditions of participation being identified.
